The insurance company will make an offer to you based on the total impact and whether or not you treated for your injuries. If you did not treat for the injuries they might make an offer to you as a good will gesture. If you do not agree with what they offer you, you have the right to ask for what you think is fair. Attorneys are not always necessary as they do charge a fee and you will most likely end up the the same amount anyway if not less after Attny fees.
Ask them to do it outside of insurance, if they can. If you want to call them negotiate a deal and not even put it through or claim it on insurance. This will also keep your insurance rate the same.

Ask your agent. If your daughter had no injuries, why should she have ANY settlemetn? If they offer $500 for her, grab it.
taking bits and pieces of other answers... if your daughter was not injured then anything is fair. They are paying her to sign a release for them which is fine since she is not injured. and from the last answer, if the inj is minor, you should be fine w/o a lawyer. they atty will increase the overall cost of the claim but once he takes his percent you usualy get about the same anyway. You have to watch out also, some atty s will turn around and file a claim with your own medical coverages if they feel they are not making enough from the other company. This is fine if you have the medical coverages and want this to be done but this should be your choice not thiers.
