I will start by saying I do not recommend anyone file their own bankruptcy. If you make one single mistake, file the wrong paperwork, miss a deadline, or any of a thousand thing....your BK will be dismissed and you get to start all over again....in 6 months. During that time you can be sure your creditors will be working like crazy to collect whatever they can. I know someone who had their BK dismissed, and the very next day the repo guy took their car. That said....keep in mind that filing bankruptcy does not necessarily mean you will keep your car. You will have to reaffirm the debt and pay it off. Otherwise you just turn it over and the balance is included in your BK.
you probably wouldn;t even qualify for a chap 7 - you might have to do a chap 13 with a repayment plan - and if you have to ask how you would file, then you definitely need a lawyer - there is tons of paperwork to fill out and I ve hard it costs at least $2000 to file anymore - how did you wind up with a loan so much more than the value? - if they repo it - after all the fees they add on you re still going to owe probably close to 20,000 - it happened to me 8 yrs ago - I wound up owing more after the repo than I did before and no longer had the car
Places like office supply stores have kits for about $20. It s not required that you have an attorney. You might try legalzoom.com and other websites that sell legal paperwork on the internet. The kits and these websites should have all the instructions, but I can tell you that it s more complicated now that it used to be. In Texas, your homestead and one car are protected. Also, two mules and a plow are protected, but most people don t have those anymore. Chapter 7 might not even be the best option for you since you don t have loads of maxed out credit cards.
Most office supply or legal form stores will have the information, and supply. You can also check on line, or go to legal aide in your city. But if I were you I would go to a counselor, and see how you should proceed. Don t do it alone, unless you get all the info that you need.
Yes...but a botched BK filing can come back to haunt you...be careful....In essence, you d be filing Chapter 7 over $11K...this may sound like a lot of money...and it is...but I would not recommend filing a major Chapter 7 for this amount of money....
Sounds scary. I filed and found someone to do it for $300! Look around first. But I think the bankruptcy laws require you to pay it back now. I think that changed last year.
