The employer can get in big big trouble for denying a support order! If she cannot get a reasonable explanation for the late payments, she needs to file a complain with the court.
Your friend does not need to put out any money for an attorney. Not in this case. She can either call her District Attorney office [child support division] or the local legal aid may help. I d start with the DA because they are usually the ones [well, in my state] who takes care of that. If there is an order in place and BOTH the father and employer ignore it then they both can and most likely will end up in jail. That doesn t really get her support paid but it could be a good lesson for them so they will do what s right from now on. Have her call the DA they do this service for free. My ex used to not pay either but now they take it out of the pay check. He has no choice but to pay, or he d go to jail or lose his license.
There are agencies out there that will help women to get the support they need and deserve. Search online for one in your state and city. My college roommate worked for one when we were in school. She would get to sleuth all around for these dads, find them, and then have their wages garnished, or put them on a payment schedule. I don t think the mom s had to do anything but fill out paperwork. It was a non-profit that did the work. Good luck to you and your friend.

Call the child support agency and tell them how inconvient it is amp; also how he is making money without telling the govt. That or threaten him that you will tell the govt that he is making money under the table. I have a dead beat dad amp; we almost have to pry the money out of his hands.

its very easy but degrading....she needs to go to the welfare office and file for foodstamps or medical assistance and tadaaaaa~ they hunt him down like the dog he is to support his child.....worked for me:) free of charged....by the way I didnt qualify for foodstamps with my income and it still worked so dont let her be discouraged by if she has a good income!
It sounds like she will have to put some money out and hire a lawyer. The best thing she can do is have his paycheck garnished. At least this way she will get the money every month with out having to deal with him.
I would send a letter to the owner of the company and let her know if she doesn t start taking the money out of his check you will report her. And if u get no response try calling her, explaining the situation. If she still does not listen I would picket outside of his dance class while he is teaching, or ask for donations because the guy who is teaching the class doesn t take care of his kids!!!!!!! one of our local news chanels did a big story on dead beat parents, I say parents because some times it is the mom s who are dead beats. Our news paper even put the names of the dead beats in the paper it. I would let it be know all over the town wher you live that it is going on you could try standing out side the dance stuido and tell everyone who enters that he is a dead beat, flyes with his picture on it may work too. At lest he has a job.
The owner of the compnay does not have the legal right to disobey an order for garnisment. They could both go to jail. The taxing bodies of the state and IRS, Social Security and unemployment would be interested in all this money being paid under the table to avoid taxes. The support agency should put out an order for his arrest if this has happened more than once or twice. He is guilty of contempt of court.
I really don t believe it is going to be that easy. Maybe just take him to Child Support Court without a lawyer or talk to someone in the Child Support Bureau. Hope this helps. And honestly I would just kick his ***. Hope this helps
As a single parent i believe she can get something called legal aid or something like that which is free legal advice? best to google it. Apart from that the CSA is the only other choice, they take along time thou and can be very fustrating. The maintance he should pay is 15% of his wages but if he gets cash in hand and lies about getting it then she may be stuck as he wont be paying taxes. But she should be getting benifits as a single parent? if he pays maintance his money will come off that 1st and if any left over she will get it.
