Should i hire a lawyer or apply for canadian permanent residency on my own? -

Some tell me that an immigration lawyer isn t necessary, since he will not be able to make the process go any faster. Others say it makes a lot of sense to use a lawyer since this is his area of expertise and i need to make sure everything is done perfectly.

If you do have the necessary qualifications such as enough education and work experience, good in English or French to the extent that you can easily communicate, age under 40 and over 18, and NO criminal records, you don t need to hire a lawyer. Because a lawyer can never make you qualified. and the process is not that complex. You just fill up the immigration forms, attach them to the required documents and pay the fee. Submit them to your local or regional embassy, and that s it. the only problem is that you just have to be patient, for it might take a loooooong time to get landing visa. A lawyer asks a lot of money to do the above for you, and the one who has to do the difficult part of quot;waitingquot; is just you. S/he can t do anything for you in this regard.

You can easily do it yourself but if it gives you a peace of mind to have a lawyer do it then go for it. If you are considering a skilled worker application, you might want to wait a bit since they are changing the rules for it right now.

What woulld be best course for allowing foreclosure to happen? Should we hire lawyer ? -

Our payment went up 75% due to tax reassesment and had to move because of job so we do not, nor can we afford the new payments. We don t care about the house but is there any easier way to get it over with and try to save some credit or, is it a lost cause? Should we even seek a lawyer or just let it happen? Try renting the house out until the market rebounds. You may have to contribute a small amount every month, but it s better then losing your credit status. With so many foreclosures these days, it should not be a problem renting.

Well, this is weird because your tax assessment has nothing to do with your mortgage payments. I would check this. The only way that your mortgage payments would increase is if your interest rate is a variable rate. Regardless, why let the house go? Sell it and pay off the mortgage because this will be on your credit history for the next 7 years. It will make it very hard to get decent financing elsewhere.

I worked collections for both Chase, and Countrywide, and to be honest there is not a lot you can do. If you talk with the collectors, then your going to have a lot better chance of them helping you with in the long run, (that s really all were here for). They could do something like payment plans, or Loan Modifications, etc.. See about a refinance, so you can lower your interest, and make payments until you can sell the home. Another good way to save some credit is to do a short sale.. Talk with your lender about a short sale, and if they offer it.. Basically what that does is you can t sell your home for what your loan is worth because the market is crap, so you lower the asking price below what your loan is.. Example: Loan is worth $300,000, you have been trying to sell the home at that for awhile now and no offers, so you lower the asking price to $250,000 and get a offer. Once you have that offer you can then get in contact with your lender again, and let them know and do a short sale which means they will take the $250,000 and cut their losses.. If your not to far behind then you can also do a Deed in Lieu, which is where you surrender the property to the lender to satisfy a loan that is in default and avoid foreclosure proceedings. Your only way to save any credit is to do a short sale make sure when you list the home you go with a Realtor who knows the ins and outs of a short sale because if they don t it will drag on for a long time the other thing to do is call your lender if you have an 80/20 mortgage and ask them to forgive the second mortgage.

That s exactly what I did, 21 years ago. But my family already had a relationship with the lawyer, so it was ok to call him at home. If you don t already have a working relationship with a lawyer, are there any in your yellow pages with an emergency number? Also I d advise you to start with the police - they may snub you, but they have to write down that you called, and that s an important start. It s very frustrating because the cops usually turn out to be wrong about the snub - just plow thru and make sure there is a record of your call. Bear in mind that if there is no court order stipulating who can and can t take them out of state, this may not even be illegal. It would be a matter of going to court and retroactively deciding who can do what. This is why you re supposed to have it done ahead of time, in case someone gets squirrelly.

If you have court papers not allowing this, then call the police. Just in case the lawyer is not available. I d call on a holiday for this because an emergency injunction might be needed.

I would contact the police first. Then contact a lawyer after the holiday. Some lawyers might have an answering service that might be able to get a message to them at home.

I would, if it were my lawyer that I ve already got. If I didn t already have a lawyer, I d call the police and file kidnapping charges. And/or the F.B.I.

Unfortunately, there is not much you can do. You can call an attorney at home, but that does not make them have to help you out on the weekend, and you would need a judge to enforce anything that a lawyer types up anyway. You can t call the cops either because they will tell you it s a civil matter and there is nothing that they can or will do unless the other parent has broken the law in some other way.

How would I complain about a lawyer? -

We hired him to represent my Son custody case and the Mother has been in contemt of the court order 8 times the lawyer has done nothing.Now my Son has to pay 600.00 for a youth service and a DMV for both her and him plus he s been paying child support and does not see his child.

Contact the State Bar Association in your state with your documentation of his infractions. And find another lawyer to assist you with your custody case, as well as the complaint.

Whats it like to be a lawyer/solicitor? -

I m considering going into law and was wondering what it s really like. I know the only real way to know would be to get work experiance but I want to know what people think as well. Was it better or worse than you expected? Was it hard to become a lawyer/solicitor (grades etc)? What made you want to become a lawyer/solicitor (personal qualities etc)? How did you decide what type of law you wanted to specialise in (family, immigration etc)? Why?

I find it very rewarding being a solicitor and love the sense of achievement when I win a case for a client. I found the road to becoming a fully qualified solicitor hardwork (especially since I studied for my LPC part time whilst working for a solicitors firm full time) but it was all worth it in the end. Also, I think it really depends on the type of law you want to practice, since some areas (i.e. Family) can be quite emotionally draining at times given the nature of the client s problem.

I love being an attorney (for now). It s a challenging, intellectual job. I like being an adviser to my client, and I like having the answers. It is a hard road, as school takes a long time and (in the US) is very expensive. As to type of law, I like business, so corporate law was a natural fit. Within that, I found a group I clicked with and am very happy. However, there is plenty of variety in terms of type of law to practice. Good luck.

How can you get custody of a child with out paying a lawyer? -

My step-daughter pretty much lives with us. We have had her for 9 months straight. Her mother does not come and see her nor does she call. My hub even pays child supoort. Everytime that we have the $$ for a lawyer something comes up and we cant afford it. Isent there some other way that we can gain custody? The mother says that she will sign over right but even to do that it will cost us $800.

Go through the Attorney General s office or whatever office represents children s rights in this type of case. In Texas it is the attorney general. Google for child custody/child support. If you could get it into court over a change in child support to get that waived or reduced based on you having the child for 9 months of the year, you could then also request a custody change. im not sure what country your in but if you have a family court go and speak with a family court lawyer,the first visit is free and if it is found you cant afford to pay,you could be intiled to legal aid, and the court fees wavered.

talk to a social worker they are state funded so it wont cost you anything to talk to them ...they might have a cheaper route to go ....but when it comes to your kids there should be a way to find that cash...

Who has legal custody of this child? If there is a court order that the mother is breaking something should be able to be done through contacting Human Services or Social Services in your town. Nothing in a matter like this is easy. You may have to prove that you are suitable to care for this child. Have all your facts straight and tell the truth. Make sure all who are envolved are being truthful and will go through with the procedings once imposed. go down and get a court waiver of cost for custody and ask question to the clerk which form to fill. paralegal might help to. check the FAQ of family law for your state. and a writing statement that the mother doesn t want the child to care for any more.

Contact your state s support enforcement office. Also try legal aid agencies - the state Bar Association or other legal associations can refer you.

Check the rules for your state-but it doesn t sound like you have a battle for custody..the mother agreed to give her up. $800 is very little money to make a difference in this child s life...ask family, friends, anybody, to get the money. A lawyer will cost you 5x that amount. Do it for the little girl...if I had some extra $ I d send it to you myself, but I have the opposite prob-my ex wants joint custody, but he hasn t seen my twins since last Labor Day..just wants control..crack makes people weird! Anyway, get the $$$ and change her life!!!

Can a lawyer whose is representing a case also sign the documents as the notary inthe state of Ohio? -

any document that has to be notarized should be done by someone other than those with a direct interest in that document. it is a clear violation of ethics. the notary is supposed to be an impartil witness to any transaction or legal document with no involvement what so ever.

Most attorneys have an office assistant who is a notary public. However, if the attorney was a notary, and was representing one side in a case, I would think there would be an ethical conflict in being the notary on an agreement.
