Levy was a lawyer who punched someone. If he was arrested and released on bail, can he still be sued civily? -

Should Levy answer the summons he recieved for civil court for one million dollars in damages? A. Yes, because Levy can be sued in both civil and criminal court for committing the same wrong. B. Yes, because as a lawyer, he s an officer of the court and is obligated to appear for every summons recieved. C. No, because Levy may not be tried for the same offense twice. D. No, because to appear in civil court would violate Double Jeapardy.

A.) Think about it, how many times do we as Officers get sued for damages in Civil Court after being cleared or found guilty from any criminal liability? But the civil action usually takes place after the criminal proceedings have been cleared.

A would be correct. B is wrong, being a lawyer has nothing to do with it. C and D both say the same thing

Sound like a question from a lawyer s class or ethics class. Either way you need to do your homework. What does the reading assignment lead you to believe is the right answer.
