Should I tell the ex first, or wait for his lawyer to tell him? -

I have a custody/support hearing coming up soon and I m in opposition to his proposal. Should I let him know so he has time to think about it, or wait and let his lawyer dump it on him? I m hoping to settle out of court or at least get a continuance until I get some help. I m doing this on my own.

If you had an attorney he would be doing this for you, since you don t, put s you in a tough spot becasue attorneys will usually try and negotiate before a hearing if possible. If your relationship is rocky, maybe you should talk to his attorney and let him tell him. If you guys are on talking terms, you may be able to tell him and work something out, then when you go to court you and his attorney tell the judge you ve settled. But if you come to an agreement before the hearing, be sure to get it in writing right away.

Let his lawyer tell him that will give you a little more time to prepare for yourself. It s always good to act nice, friendly, but at the same time you should also do what ever will benefit you the best. Good Luck. =)

If you want to settle out of court, tell him yourself and don t wait for his lawyer to do so. His lawyer is against you and against him as well. He wants to get the most money he can out of this. Try to work without him being involved. But, quite frankly, the lawyer WILL drag this thing all the way to the court. Unless you convince your ex to get rid of him and settle.

I think you have answered your own question. If you are hoping to settle out of court, you would have to tell him before court, wouldn t you? What am I missing here?
