Your bargaining position is best by settling quot;out of courtquot; -- i.e. before the trial begins. The agreement will be submitted to the judge, who will sign off on it (making the agreement legally enforceable!). You will have to pay all past due rent plus late fees and penalties, damages caused by you or your roommates/guests/visitors, and court costs and legal fees for bringing the action. If you negotiate and can pay a goodly lump sum, they likely will let some of the costs go, such as interest and late fees. And if you aren t out yet, you have to agree to a date to vacate -- for a goodly lump sum, they may dicker a bit so you can find something and move your stuff. The court may give you as little as 3 days. By dickering, you may get a week or two.
You strict a deal outside court. If you are the renter this is your lucky day! If you settle out of court this will not be recorded on your credit unless the landlord specifically asks the judge.
