How does one go about finding a good lawyer? -

I have a malpractise case I need represented and have no idea how to find a lawyer. I live in a small town so there isn t much to go on... how do you get a good lawyer?

In small towns it s hard to find an attorney to take a malpractice case (I m assuming it s medical). Those cases are very difficult and expensive to pursue. If you call a local attorney, even if he can t take your case, he probably knows of someone who might. That attorney might practice some distance away, but once you find him/her, you ll get a good opinion on whether your case has value.

call the State Bar and ask for names of lawyers who specialize in malpractice. See if the lawyer has had complaints filed against him, they`ll tell you if the lawyer has and how it has been disposed of or IF it is pending. There should also be some listings online in your area

Find out the best law firm in your city or state. For example in Detroit there is a high profile lawyer Geoffrey Fieger who defended Jack Kevorkian in an assisted suicide case that was a huge media circus. I had a malpractice suit, and even though his office did not handle those cases they gave a referral to another firm. I ended up winning the case. At least for Michigan there is no point going for 2nd best in malpractice cases. Because whatever law firm you take on is going to be paid on contingency - 1/3rd if you win, nothing if you lose. You pay the same if you get a great firm or a shoddy one and you only get one crack at it so just get the best.

Google quot;Martindale Hubbell Law Dictionary.quot; That ll give you a list of just about every lawyer and law firm in the country, and they give lists by specialty. That ll help you find all the lawyers in your area who specialize in malpractice cases. After that, the best advertisement for a lawyer is word of mouth. Be leery of lawyers who advertise on TV -- they re usually unscrupulous, unethical, and in it just for the money. Ask around. You can also check with the Better Business Bureau to see if any complaints have been filed against any lawyer you re checking out.

Contact your local county Bar Association for attorney referrals. The attorneys listed on the local bar association list should each carry their own malpractice insurance on themselves. Also, word of mouth is one of the best ways to find a competent attorney. However, be sure that you find out if the attorney you are looking at hiring is competent in the particular type of case you are pursuing for a lawsuit. Each state has a state bar association website. Look up the attorney s name you are looking at hiring on the state bar association website and see if they have had any complaints/grievances lodged against that particular attorney. Finally,before you just rush out and hire an attorney because the attorney quot;looks goodquot; on paper, meet with that attorney and see if your quot;gut feelingquot; tells you that this attorney is the one for you and your case. Also, if after you hire this attorney and you decide you no longer want this attorney representing your case, you can always change attorneys by firing them. One caveat, however, to be aware of is that if it is too close to the trial date for your case be tried, the judge for the court your case is filed in may not allow that attorney to withdraw from your case.

Martindale is generally considered the best resource but nothing replaces word of mouth. P.S.- Don t forget that if you are not happy with your first choice you can switch to a different lawyer.
