Is it necessary to get a lawyer for workers comp? -

I just need to know if it is absolutely necessary to get a lawyer to receive workers comp, if not what is the process of actually getting it. Does it have to be through my employer or can I do it myself?

You get your own WC lawyer. The lawyer s fee is regulated by statute, and he gets a portion of your recovery. Do NOT get one suggested by your employer. If there is a union where you are, ask the union to recommend one. Without legal representation, you are at the mercy of the system, which starts with your Physician s attitude toward the system. Many MD s are reluctant to get a patient all that is reasonably coming to them, as they often make a lot of money from referrals from that very system, or do not want to be professionally attacked as retribution for quot;costing them moneyquot;. Many MD s are hesitant to even apply for the money due them, and will bill the patient for everything which should have been covered, often screwing up the system s application paperwork on purpose. Many MD s feel they are the patient s advocate, and resent any attorneys being involved, even if they are an ineffective advocate due to any reason. It is a personal decision you will have to live with, to give up a percentage of any settlements, which should be based upon whether the settlements would actually occur in proper amount if unrepresented. i tell you from experience get one 2/3 is better than nothing there was all type of paperwork I was so glad to get one
