This doesn t sound like a rip off. It sounds like the settlement just happened when she called you to see if you like it. They probably won t have the details on paper, finalized, checked, and so on until the day before court. The reason she s waiting until just before court to tell you is so that you don t pay extra for a phone call or letter with her, and so that she knows all of the final details. If you are really worried about it, call your lawyer closer to the trial date. Sure it will cost you whatever your lawyer charges for fifteen minutes, but if it gives you peace of mind it will be worth it to see what the deal will be. Really, I don t think you need to worry about it--just go to court and see what they came up with.
Call your lawyer and tell her you want to see the settlement offer. It s always in writing. Don t let her stall, bullshit or bulldog you. Remember the case is you vs workers comp. Your lawyer is YOUR employee. Remind her that she in fact CAN be replaced. All you have to do is call the judge and let him know first then call the lawyer and can her.
Damn G, you beat me to it. I was going to say look to see if she is breathing and you ll know. However, your lawyer should tell you exactly what the offer was and how much her cut is. You are the one who gets to decide whether to take it or not.
Your lawyer can t cheat you out of your money. Any check will come to YOU, not him. On the day in question, you will find out the full information. If you really must have it sooner, tell your lawyer that. He works for you, he will do what you tell him.
Tell her you want to know the complete offer, including future payments and their duration, and her compensation.
You could always get another lawyer to deal with your workmens comp lawyer.
How do you know they re cheating you out of money?? The answer is.. They are Lawyers. The end.
Is he a lawyer? If yes, then he s cheating you.
Does he have a degree in law? If so, he probably is.
