Your friend is nuts. How much was the jacket. Fifty dollars or 100 dollars. Then her daddy will spend a thousand dollars on a lawyer. Doesn t make any sense to me.
Unlikely. It does NOT take a video to prove she walked out the door with a jacket she did not pay for, all it takes is reliable witnesses. Leaving the store and being apprehended outside shows intent to NOT pay. Simply wearing the jacket IN the store means nothing, as you always COULD pay for the jacket as you leave, and you could be wearing the jacket the whole time. However, leaving and being apprehended outside with a jacket not paid for, well, the jig is up, guilty. Which is why MOST stores will wait until someone actually LEAVES before confronting them about shoplifting. As long as you are inside the store, you can always say your intent was to pay even though you put that expensive object in your pocket. The witnesses just have to be credible. If they ARE credible, in that they have nothing to gain or lose by lying and no personal grudge, then there is no reason NOT to believe the witness testimony, and again if they saw you walk out and not pay, guilty. What do you think stores did before there were video cameras all over the place? Any lawyer may be able to cloud the issue, but no matter what the lawyer does or says, if the witnesses say they saw her leave the store and not pay, then she is going to be found guilty. Sure it is possible, just like 3 feet of snow falling on Miami is possible, but it sure isn t probable no matter HOW good the lawyer is.
ABSOLUTELY, an acquittal is possible! She should definitely seek legal counsel...lawyers know all the tricks to get charges withdrawn, to obtain an acquittal at trial!! I have gotten off criminal charges SO MANY TIMES (at least a dozen) with the help of a mediocre legal aid lawyer... something as simple as a loss prevention idiot not showing for trial can get your friend off the hook! You ve got to remember that loss prevention idiots are exactly that...idiots...they were too stupid, fat or slow to become police officers...so in their stupidity, they will make a lot of mistakes...mistakes that could mean she walks away a free and happy girl!! The other answerers simply have not had experience with lots of criminal charges against them, so they do not really know what the Game is all about. Odds are, the security folks caught her taking the jacket out the door... which is pretty damning. There will be multiple witnesses that will be called, multiple statements showing irrefutable proof that she did it. Her best bet is to get a lawyer and beg for mercy.
ok lets see if she is a juvy she will be fine but if not there might be a possibility if no witnesses or evidence. If she is found guilty um and she is a juvy she will be fine the police will just try to scare her so tell her that your all right and keep our head up!
Depends upon how many people saw her and caught her. If she got caught by 2-3 store employees with the coat she is not going to get off. Your friend is an idiot if she was shoplifting.
Did she conceal the jacket? Did she take it out of the store? Were there store employees as witnesses? She d have to have some damn fine lawyer.
