How difficult is it to sue a lawyer? -

Even if you quot;wonquot; (settled) the case but felt you were being belittled, brow beaten and several other things by the lawyer at the time? But the incident you were suing over was so overwhelming that it was all you could do to survive at all. So you just put one foot in front of the other and put up with it. He made many mistakes on my case and those mistakes cost me plenty.

In general it is not hard to sue a lawyer for similiar things that you can sue a person over. However, it is difficult to sue a lawyer over mistakes made in the case. You would have to prove malpractice, and to do that you must show that they seriously screwed up your case, no one else could have done better, and you were hurt by it. You cannot have your own case re-heard, it was already decided. Suing the lawyer cant change that. But if you feel that you have enough evidence against the lawyer, then go to another lawyer, and see if they feel the same. If they do, then they may take the case (I would only accept a contingency fee for this). Also, you can go the the bar of the state and report them. If the bar thinks that they screwed up, they will be punished - reprimand put on their license - all the way to disbarred.

I m not sure which country you are from, but here I believe you can t sue a lawyer for being a bad lawyer. I guess they assume if you re a lawyer you must be bad : ) But seriously, I don t think it is allowed.

He made mistakes. Well, what kind of mistakes? If these quot;mistakesquot; were a gross deviation from the general practice of attorneys then you could turn him into your state bar association. However, keep in mind that lawyers are not paid to be nice to you. Or treat you kindly. If they are arrogany a--holes, then you can fire them, but there is no legal right to a nice, considerant attorney. Secondly, I would think that in entering your settlement you waived the right to appeal and signed a statement that you will pursue no other charges against the defendant. As such, you can t seek a new trial based on ineffective counsel. As for suing him, well, you could try but unless you could prove negligence (probably gross negligence) then you are out of luck. You might no like the result, but you should have fired your attorney at the time.

First file a complaint with your state s bar, they will determine how much he has done wrong. Most likely he will lose his license and then you go in for the kill and sue............
