everything you have already been told is pretty much right, so I won t bother to repeat it. I wish I knew exactly what the offense was. Just guessing, if it was speeding, the people I saw who were trying to fight it lost. They asked the cop how was the radar set up and they said they calibrated it. If you are fighting speeding, the best thing you can do is get your speedometer checked for accuracy. Every person I saw fighting speeding was asked that and they all said quot;noquot; so they lost right there. Anything can make a radar mess up. He could have scanned someone else and got you by mistake. I m sure the cop is not gonna care if he tickets the wrong guy. Since you are a good student, study up on the flaws of moving radar and take that to court. I wish I knew more about your case, but all I can say is you have nothing to lose and everything to gain by fighting so bring all the evidence you can- facts, pictures, and witnesses and give those boys a run for their money. I hope this helps.
Two ways: 1- Pled quot; Not Guiltyquot; and let the Judge decide. 2- Ask for a jury trial and let 6 people decide. Usually they will decide in your favor. There is no cost for you to ask for a jury trial.
It can be done if you have evidence. Someone was pulled over rushing wife to hospital because she was pregnant and bleeding. The judge threw out the ticket because of that.
I went to court by myself and won.
probably. or else u would lose the case, look like an idiot for even trying, and end up paying it
Yes, go in prepared, and don t be scared and back down.
I don t know what State You re in, but Here, in N.C., You can Plead Guilty to a Lesser Charge, and then Plead Your Case to the Judge. The Case just might get Dismissed! If You Plead not Guilty, and You re found to be Guilty, then the Penalty will be far more Severe. I faced the same Thing, and went to the D.A. s Office, and asked to View My D.M.V. File,[Driver s Infraction Record] and saw that I had an otherwise quot;Cleanquot; Record. The Penalty in Court was Reduced by My quot;Lesserquot; Guilty Plea, to Exceeding a Safe Speed. I was Guilty of 65 MPH in a 55 MPH Zone. Had I Pleaded Not Guilty, then the Fine would have been much more.Plus, I would have received Insurance Policy Penalty Points. That s what I was really worried about! I Think My Total Cost was around $75.00.If You re going to Argue Your Case as Your Own Lawyer, and Plead quot; Not Guiltyquot;, please remember the Old Saying, quot; A Fool is His[or Her] own worst Client!quot; I know it s Wrong, but quot;Theyquot; often resent Us quot;Little Peoplequot; Playing quot;Lawyerquot; without a Legal Degree!
Yes, sometimes charges can be reduced and if you have more than 1 violation you may have one or more charge removed by stating your case. First you will have to plead innocent and a court date will be set for your trial. Usually a Clerk of Courts will hear your case before you go before a Judge and after stating your case to the Clerk will recommend a lesser sentence to the Judge.
yes, people state their case all the time without a lawyer. A Judge can appreciate an intelligent person who can stand up for themselves
certainly , i won twice in trafic court w/o a lawyer. have acurate records , know the law, be polite ,CONCISE[brief]but complete, dont say more , dont say less than you have too.... and be lucky... some judges just dont care about anything... and if you know you are at fault dont waist your time... i ve won 6 cases in court never lost ... manly because when i m in the wrong ... i dont go.. i pay and end it !
well if the officer doesnt show up you definitely can get out of it but if he does then its your word against his and well you can be SOL
yes. Most of the time you can get out of the ticket especially if the officer who gave it to you is not there. But, even if he is if you are not a repeat offender I think your chances are good. Remember, judges sometimes get speeding tickets too but, be prepared to pay court costs if the ticket sticks but also watch what you do for a while as well if you get out of it.
no. It s not a crime, so you are not quot;innocent until proven guiltyquot;. Its a preponderance of evidence, and the cops word will trump yours unless you have CONCRETE evidence you are innocent.
No, you cannot fight the ticket, you are truly doomed to go to jail, go to jail or die. The system always wins. Good bye, my friend and thank you for all your questions. Next....
If the officer who ticketed you doesn t show up, you win.
A ticket is one thing you definitely don t need a lawyer for. Just state your case, it is your word against the cop, not saying you will win, it is a toss up, but all the lawyer would do is repeat the same facts. Read the ticket carefully, look to see what the reason was and argue very specifically.
