Can someone explain what a lawyer helps you with? -

There is a family member who is in some trouble and they want to give this person 10 yrs to life and the lawyer hasn t done much at all to prove his innocence. The lawyer told him that there is nothing he can do anymore and just wait; when in the first place, it seems like he has done nothing but just listen to what the fiscal has to say and transfer this information to this family member. What exactly is a lawyer suppose to do or what can they do in order to prove someone s innocence?

Richard has stated the situation quite well; I would only add my view that the most important thing a lawyer can do is to understand the facts and circusmstances of a case in as much detail as is humanly possible; it is only then that you can examine witnesses effectively and create doubt about the state s case. Some cases are very difficult or even nearly impossible to defend ... then you try to negotiate a plea. Please remember: lawyers are lawyers, not magicians ... don t believe half of what you read about superstar lawyers quot;getting people off.quot; Most criminal defendants are convicted and that s that. And a truly first rate defense is quite expensive because it takes a lot of time and considerable skill.

Lawyers are sneaky coniving devils and if you have one who is good at there job they can do all kinds of things to help. First of all they know the laws better than you. Secondly they can shuffle around court dates and evidence so much that all kinds of evidence and paperwork get lost in the mix. Your lawyer sucks. I would look into changing councilers and right away.

It s not up to the Defense lawyer to quot;prove his innocencequot;. It s up to the State to prove his guilt. That happens at trial, not before. I gather from what you say that the case has not yet gone to trial? If that s the case then the State (Scotland, I d guess, since you refer to a quot;fiscalquot;) is TOTALLY in the drivers seat as far as timing goes. The lawyer cannot force them to go to trial before they are ready, and there s nothing to prove until it does go to trial. Pre-trial the defense lawyers job is almost all paperwork. He has to make sure that he gets all the prosecutions evidence before the trial starts, make sure that all witnesses are booked in and that he knows what they are going to testify to. He should also have examined the circumstances to see if there s anything that would give him grounds to move to have anything excluded, and done investigations into anything that would impeach the credibility of witnesses - his or the States. base it on how much u pay yr liar or lawyer, i think the more u pay, the slower they talk. some times more money could mean a lighter sentence. but in the end it s the gay guy in the dress behind the big bench drinking vodka, that ultimatly decides the end story.

Wow. This sounds exactly like a case that s I m handling right now. Hopefully, the lawyer you re talking about is not me. Anyway, let me set you straight on a few things. A lawyer is not a fairy god mother. He can t wave a magic wand and make the trouble go away. It could be that the lawyer can t do anything to reduce the time that the person is going to spend in jail. In some cases, the the defendant has gotten himself in a big mess and has confessed or been seen on video or done something that is irreversible long before the lawyer gets involved. At that point, the lawyer may only be able to give the defendant two equally bad options: 1. Plead out to a huge amount of time OR 2. Take it to a jury trial and probably get even more time. I deal with a lot of DUIs. 95% of the time, there is nothing I can do. The person is usually stopped lawfully (or the cops are going to be believed and not the accused as to what occurred). And they were in the car and they were drunk and they had a blood alcohol concentration of .15 or .25 or something really, really bad. If the cops didn t stop them legally or they were near the legal limit or it s unclear whether the accused was actually driving, maybe I can do something. If I can t do something about their innocence and the DA wants to send the person to jail or prison and the judge wants to go along with the DA, our options are limited. If the person has a record that goes back a long way, then the judge is unlikely to cut the person a break. If the person has been to prison a bunch of times or has a strike or two, then the options become very limited. Also, an attorney has a lot of cases and each case doesn t progress quickly. It usually takes weeks just for a case where someone wants to plead quickly to run its course. A case where an attorney is trying to get a not guilty verdict will take 2 months at the very least and more likely 6 months. An attorney should be doing an investigation and it takes time to request the investigation and for that investigation to take place. Of course, if this is a private attorney, and the client doesn t have money for the investigation, but just for the attorney, you are unlikely to get an investigation. You have to pay for that, too. Additionally, I have found that some people have unrealistic expectations. Clients want motions that the attorney knows can t possibily win. A lot of people think that the justice system works the way it does on TV. It does not. The judges and jury often believe the cops. And it s not about being a silver tougued devil who can dance circles around the other guy. Usually, both attorneys are very competent. Don t expect a criminal defense attorney to roll over a DA. The DAs aren t stupid. They know what they can bring in and, in the vast majority of cases, the DA has all the good evidence. While there is certainly drama in a criminal case, it s not about surprise witnesses showing up at the last minute. The attorneys know what s coming long before it comes and are ready for it (or they are supposed to be). The criminal defense attorney s job is to analyse the evidence in light of the state of the law. The criminal defense attorney then takes this information to the defendant and makes a recommendation. It is then up to the defendant to make a decision. To go to trial or to plead??? When the defendant makes that choice, the attorney then comes up with a game plan to try to get a good result for the defendant. Notice I said quot;try.quot; If the defendant goes against the recommendation, the attorney can only do his best. He should continue to make recommendations as the case progresses. He should explain the law and the reality of the court he is in and the DA he is up against. It is never about proving one s innocence. It s about getting the best result. If the DA had doubts about the defendant to begin with, the DA would not have charged the defendant in the first place. Of course, if there is serious evidence regarding the defendant s innocence, this should be provided to the DA and must be at some point before trial. Maybe the DA can dismiss the case. Of course, what you consider to be serious evidence and what I consider to be serious evidence are two different things. Just because someone says they are innocent doesn t mean they are. I ve had clients who confessed on tape over a tapped jail house phone or who clearly committed the crime on video tape, but they said they were innocent. After what I ve seen and heard, you have to forgive me if I don t take your family member s word for it. I always reserve judgment, but what I feel and believe is irrelevant. What I can prove or what holes I can punch in the DA s case are what is very, very relevant. But if there is something there and the attorney isn t doing anything about it, you should considered getting a new attorney.

First off, if this person is guilty of the crime, then he deserves to go to jail no matter who he is or how nice of a person, guilty is guilty. But, if he is not guilty, then the lawyer is supposed to take all the information from the person involved and try to prove his innocents. Gather all the evidence he can, get a copy of the police report, copy of the witness list if any, interview them to as what they saw or heard and compile any proof that he can to show that the accused did not take part in the crime that includes going to the crime scene and trying to reenact any part of it to see if it makes sense. These are things that a good attorney will do, he will investigate the case to bring about the best possible out come. That could even mean taking a plea deal instead of going to court. If the attorney he has now is not doing his job to your or the other persons satisfactory, he can fire him and get another attorney, if he is a court appointed attorney he can go back to court and ask for new representation and charge the attorney with false or misrepresentation and dereliction of duty. If you have any questions about the responsibilities of any attorney, call your local Bar Association the number will be in the phone book in the attorneys section, you can also report him to the Bar Association for the same complaints of dereliction of duty and misrepresentation. You don t have to go to paralegal school to do it. My sister got a bachelors in managment, and had a file clerk job at a law firm during school, she then was offered a paralegal job by the same firm and made I think close to $40K a year, but she was also intending on going to law school, so i don t know how much that played into her getting that job. I work in Tucson, Arizona and average $40K per year. Phoenix pays more and other states like Washington State in Seattle make upwards of $55K to $65K per year.

What is the training/career opportunities for a criminal appellate lawyer? -

First, you d need to go to law school -- graduate, then pass the bar exam in whatever states you wanted to practice. Then, you d need to go into criminal defense for a few years, and get an understanding of criminal trial work. Then, you d need to specialize in writing and arguing appeals. There is always a need for appellate attorneys, especially in the criminal defense arena. However, it s almost always hourly work -- meaning that you charge by the hour whether you win or lose -- which means the client needs to be able to pay your fees, which is not alwys the case in appellate work. But that also means the income is more consistent -- if you can get clients -- than some civil plaintiff s work -- where you can collect percentages of huge damages awards in personal injury or products liability cases. The thing about appellate work is that you really need to love the structure of the law and the ways rules work -- it s very different than litigation, where half of what you are arguing are facts and opinions.

How can I make a written document a legally binding without an expensive lawyer? -

For example, I d like to write out a specific plan of how I want my funeral to be arranged when the time comes. Do I need a lawyer for this or what?

The plan for your funeral can be arranged in advance with a funeral home. However, when I do estate planning for a client, I include a document I created called quot;Statement of Disposition.quot; It contains whatever details my client wants. I think it is extremely helpful to your family to know your desires. This eliminates their needed to agonize about what you want. If you do such a document, the safest thing to do is write out your plans and have the document witnessed by 2 individuals and signed before a notary. To my knowledge, there is no law directly on point on this issue. The better alternative is to do a Living Will or a Right to Die Statement (they are the same thing, just different names). My Living Wills states whether you want artificial hydration, artificial nutrition, life support, pain medication or antibiotics if you do NOT have an infectious disease that is a danger to others. Many people with life threatening illnesses may actually die from pneumonia, for example, which is generally not a threat to others. In the document appoint a person who you trust to carry out your wishes. I suggest you appoint an alternative person if the first person is unable or unavailable when needed. The document can also contain organ donor wishes and, for example, cremation instead of burial. I often say: quot;I have enjoyed the love and support of my family during my lifetime and I direct my family not to spend their assets on an elaborate or expensive funeral.quot; Some of my clients want the Mass of Christian Burial if they are Catholic or have particular choices for music. You do not need a lawyer for this and many states have Living Will forms in their state law that can be copied and filed out. What is important is that the document be properly executed. Again, 2 witnesses and you should sign the document in the presence of a notary. This may be something you want an attorney to do for you. This should be inexpensive. I charge $250 for a Will, a Power of Attorney (which you also need). a Right to Die Statement and a Statement of Disposition. This is a very wise move for you. Even though you didn t ask, you really should do a Power of Attorney to give someone authority to make medical decisions for you if you are unable to do so. There is software you can get that draws up minor things such as living wills, and no-fault simple divorces. Nowadays, things are probated forever, so it would be best to go through a lawyer, but it may not even matter in the end (no pun intended). I would say, if you are just considering it as a matter of insurance and peace of mind, draw something up and have it notarized and witnessed by two people. At least it would be a starting point, if god forbid, something did happen to you. If you have children or and estate of any real value, definetely get a lawyer. ALso, there is some hotline for people to get cheap legal advice for such things, or a paralegal to draw up the papers- I think it s called power to the people or something.

In most states, what you are trying to do can not be done. Even with a lawyer, you can not do it. Most states have determined that funerals and/or cremation are for the living...not the deceased. The best way to accomplish what you want is to preplan it with a funeral home. BUT even if you do that, your spouse (if you have one) or your children CAN make changes to your plan if they want to.

You d better hire another lawyer soon to make sure your first lawyer has not forfeited any of your rights by failing to show up. Depending on teh type of case, you might also get some guidance from the applicable court on that. A new lawyer could help you release your current lawyer and ensure that your files get back to you. You ll want to state that you are unhappy with him for his lack of representation, that you are firing him and that you want copies of all of your legal records that he has. The law does not expect you to have to jump through hoops to release your lawyer, but there can be complications for a criminal trial, where the judge may need to be involved to ensure that you have adequate representation. By the way, You can report the no-show lawyer to the state bar for disciplinary proceedings (and can sue him for malpractice if he actually has resulted in your losing any money or rights).

Like the first answer, the best way to go is simply hire a new attorney. The new attorney will take care of the rest for you by notifying both the court and the old attorney that he is substituting for the old attorney.

What woulld be best course for allowing foreclosure to happen? Should we hire lawyer ? -

We don t care about the house but is there any easier way to get it over with and try to save some credit or, is it a lost cause? Should we even seek a lawyer or just let it happen? Try renting the house out until the market rebounds. You may have to contribute a small amount every month, but it s better then losing your credit status. With so many foreclosures these days, it should not be a problem renting.

Well, this is weird because your tax assessment has nothing to do with your mortgage payments. I would check this. The only way that your mortgage payments would increase is if your interest rate is a variable rate. Regardless, why let the house go? Sell it and pay off the mortgage because this will be on your credit history for the next 7 years. It will make it very hard to get decent financing elsewhere.

I worked collections for both Chase, and Countrywide, and to be honest there is not a lot you can do. If you talk with the collectors, then your going to have a lot better chance of them helping you with in the long run, (that s really all were here for). They could do something like payment plans, or Loan Modifications, etc.. See about a refinance, so you can lower your interest, and make payments until you can sell the home. Another good way to save some credit is to do a short sale.. Talk with your lender about a short sale, and if they offer it.. Basically what that does is you can t sell your home for what your loan is worth because the market is crap, so you lower the asking price below what your loan is.. Example: Loan is worth $300,000, you have been trying to sell the home at that for awhile now and no offers, so you lower the asking price to $250,000 and get a offer. Once you have that offer you can then get in contact with your lender again, and let them know and do a short sale which means they will take the $250,000 and cut their losses.. If your not to far behind then you can also do a Deed in Lieu, which is where you surrender the property to the lender to satisfy a loan that is in default and avoid foreclosure proceedings. Your only way to save any credit is to do a short sale make sure when you list the home you go with a Realtor who knows the ins and outs of a short sale because if they don t it will drag on for a long time the other thing to do is call your lender if you have an 80/20 mortgage and ask them to forgive the second mortgage.

If you have an emergency how do you contact a lawyer on a holiday? -

One parent is attempting to take the childen from the other parent and is heading for another state- can you call a lawyer at home? What do you do?

That s exactly what I did, 21 years ago. But my family already had a relationship with the lawyer, so it was ok to call him at home. If you don t already have a working relationship with a lawyer, are there any in your yellow pages with an emergency number? Also I d advise you to start with the police - they may snub you, but they have to write down that you called, and that s an important start. It s very frustrating because the cops usually turn out to be wrong about the snub - just plow thru and make sure there is a record of your call. Bear in mind that if there is no court order stipulating who can and can t take them out of state, this may not even be illegal. It would be a matter of going to court and retroactively deciding who can do what. This is why you re supposed to have it done ahead of time, in case someone gets squirrelly.

If you have court papers not allowing this, then call the police. Just in case the lawyer is not available. I d call on a holiday for this because an emergency injunction might be needed.

I would contact the police first. Then contact a lawyer after the holiday. Some lawyers might have an answering service that might be able to get a message to them at home.

I would, if it were my lawyer that I ve already got. If I didn t already have a lawyer, I d call the police and file kidnapping charges. And/or the F.B.I.

Unfortunately, there is not much you can do. You can call an attorney at home, but that does not make them have to help you out on the weekend, and you would need a judge to enforce anything that a lawyer types up anyway. You can t call the cops either because they will tell you it s a civil matter and there is nothing that they can or will do unless the other parent has broken the law in some other way.

How would I complain about a lawyer? -

We hired him to represent my Son custody case and the Mother has been in contemt of the court order 8 times the lawyer has done nothing.Now my Son has to pay 600.00 for a youth service and a DMV for both her and him plus he s been paying child support and does not see his child.

Contact the State Bar Association in your state with your documentation of his infractions. And find another lawyer to assist you with your custody case, as well as the complaint.

First, if you are unhappy with your attorney find a new one. Then depending on where you live, there is either an office of the Courts and/or a Bar Association, where complaints are to be filed. Without knowing your location, its impossible to offer more detail

Whats it like to be a lawyer/solicitor? -

I m considering going into law and was wondering what it s really like. I know the only real way to know would be to get work experiance but I want to know what people think as well. Was it better or worse than you expected? Was it hard to become a lawyer/solicitor (grades etc)? What made you want to become a lawyer/solicitor (personal qualities etc)? How did you decide what type of law you wanted to specialise in (family, immigration etc)? Why?

I find it very rewarding being a solicitor and love the sense of achievement when I win a case for a client. I found the road to becoming a fully qualified solicitor hardwork (especially since I studied for my LPC part time whilst working for a solicitors firm full time) but it was all worth it in the end. Also, I think it really depends on the type of law you want to practice, since some areas (i.e. Family) can be quite emotionally draining at times given the nature of the client s problem.

I love being an attorney (for now). It s a challenging, intellectual job. I like being an adviser to my client, and I like having the answers. It is a hard road, as school takes a long time and (in the US) is very expensive. As to type of law, I like business, so corporate law was a natural fit. Within that, I found a group I clicked with and am very happy. However, there is plenty of variety in terms of type of law to practice. Good luck.

How can you get custody of a child with out paying a lawyer? -

My step-daughter pretty much lives with us. We have had her for 9 months straight. Her mother does not come and see her nor does she call. My hub even pays child supoort. Everytime that we have the $$ for a lawyer something comes up and we cant afford it. Isent there some other way that we can gain custody? The mother says that she will sign over right but even to do that it will cost us $800.

Go through the Attorney General s office or whatever office represents children s rights in this type of case. In Texas it is the attorney general. Google for child custody/child support. If you could get it into court over a change in child support to get that waived or reduced based on you having the child for 9 months of the year, you could then also request a custody change. Good luck with this. I will say a prayer for you and for the child.

im not sure what country your in but if you have a family court go and speak with a family court lawyer,the first visit is free and if it is found you cant afford to pay,you could be intiled to legal aid, and the court fees wavered.

talk to a social worker they are state funded so it wont cost you anything to talk to them ...they might have a cheaper route to go ....but when it comes to your kids there should be a way to find that cash...

Who has legal custody of this child? If there is a court order that the mother is breaking something should be able to be done through contacting Human Services or Social Services in your town. Nothing in a matter like this is easy. You may have to prove that you are suitable to care for this child. Have all your facts straight and tell the truth. Make sure all who are envolved are being truthful and will go through with the procedings once imposed. go down and get a court waiver of cost for custody and ask question to the clerk which form to fill. paralegal might help to. check the FAQ of family law for your state. and a writing statement that the mother doesn t want the child to care for any more.

Contact your state s support enforcement office. Also try legal aid agencies - the state Bar Association or other legal associations can refer you.

Check the rules for your state-but it doesn t sound like you have a battle for custody..the mother agreed to give her up. $800 is very little money to make a difference in this child s life...ask family, friends, anybody, to get the money. A lawyer will cost you 5x that amount. Do it for the little girl...if I had some extra $ I d send it to you myself, but I have the opposite prob-my ex wants joint custody, but he hasn t seen my twins since last Labor Day..just wants control..crack makes people weird! Anyway, get the $$$ and change her life!!!

Can a lawyer whose is representing a case also sign the documents as the notary inthe state of Ohio? -

any document that has to be notarized should be done by someone other than those with a direct interest in that document. it is a clear violation of ethics. the notary is supposed to be an impartil witness to any transaction or legal document with no involvement what so ever.

Most attorneys have an office assistant who is a notary public. However, if the attorney was a notary, and was representing one side in a case, I would think there would be an ethical conflict in being the notary on an agreement.

Is being an environmental lawyer a good job, or any other type for that matter? -

Ive heard all this crap about how being a lawyer sucks and i just wanted to know if it was true for all types of lawyers.

Lawyers are just another profession; it is not more honorable than being a trashcan collector, so get those social stereotypes out of your head. Your profession or what you do for a living and just that, part of you, not what makes YOU, as long as you live with respect and dignity it’s OK. The experts in law have many opportunities to work in very different areas. You may go to politics, to teaching, to hospitals, to helping communities, to work with the environment, work in public offices, or in private ones, work in corporate law, bank law, immigration law, health law, contract law, real estate law, taxes, criminal law, international law, etc. You may just be a legal advisor or you could be in court litigating all kinds of cases. The true thing about being a lawyer is that any bachelor degree will be fine and any practice area you choose will contribute to society in some way or another. The more diverse the field the better. Any branch of law can be practice in many ways. Environmental law can be practice in public office such as EPA, in pharmaceutics, in factories, can be international agreements, marine laws. It can be practice in state law and federal law. While studying for your Juris Doctor or masters in law you will have the chance to see how many opportunities you have. And by the way, since there are so many opportunities, you will never be out of job and be paid very well.

What courses should i take if i want to be a lawyer? -

Does it worth it to file a complaint against a lawyer if he broke his promise? -

I hired a lawyer 6 months ago, I decided to fire him because he was not meeting my expectations. I accepted the fact that lawyer fees are not refundable, but he has no right to kept my court filing fees which it was not lawyer fees. He promised to refund the filing fees back to me, 3 months had past and I still have not received it.

He said, I said. Do you have his promise in writing? Were there any independent witnesses to him making the promise? If nothing in writing and no witnesses he is innocent until proven guilty and you have no evidence to prove it. You can file a complaint with the State Bar and if they get enough complaints of similar nature they might investigate it. But do not hold your breath and forget about the money.

The problem is his promise to pay was probably verbal and you really needed something in writing that he would pay you back if you file the complaint your not going to have any proof he was going to pay you back and unfortunately lawyers can get away with just about everything. Umm...Talk to your GAL (Guardian Ad litem) or your Divorce Attorney and let them know you do not have allot of money and what money you do have goes towards the children . Child support help would be beneficial and see about a modification. Just let them know that you have the physically custodial custody of the children but not legally. An associates degree would not be enough to get into law school. You ll need a bachelor s degree which is a 4 year degree. You ll need pretty good grades from a pretty good school and pretty good LSAT (Law School Admissions Test) scores in order to get into a pretty good law school. Law school takes 3 years but you should know that the best entry level positions for prosecutors are highly prized and the best federal court slots go to the top graduates of the top law schools. That said, there s no reason you can t accomplish all of this. Work hard in high school and go to the best college you can afford. Take a liberal arts oriented curriculim - history and political science are popular majors - and do really well. Study for the LSAT starting in your junior year and take it very early in your senior year. With a little luck and much hard work you can achieve your dream. But remember, if you don t work hard, or if you just do the minimum you won t accomplish it. Instead you ll be looking back when you re 40 wondering what it would have been like to go to law school. You have to get your bachelors in political science. You don t have to major in political science though, you can major in just about anything you want just take some classes that would enhance your analytical, writing, and logic skills. These skills are essential to do well on the lsat (law school admission test). You have to do extremely well on the lsat to get into law school. So when it comes time to take your lsat do A LOT of practice test. Basically if you can graduate with a g.p.a of 3.5 and up and get around 165 and up on your lsat your chances are pretty good . There s no set number. I have a good friend who does I.P. work in Portland - she works between 10 and 14 hours on any given day. My practice is more generally oriented on business and civil litigation - my days are pretty routinely 10 hours. On the other side, I have a friend who takes a very small case load and only works about 5 or 6 hours a day. If you re working for a firm, they re most likely going to have a billable hour requirement for you to meet, so that goes a long way towards dictating how much you do.

Private companies may demand a lot of hours,but family-firms work more steady hours.However there may be more personal onus when you are dealing with individuals rather than faceless companies. The same classes to become any kind of lawyer. Really, all you need is to excel at everything except the sciences. You still have to do OK with the sciences but pay special attention to Civics and English. What I do suggest is that you join a Toastmasters club (www.toastmasters.org). Toastmasters is very cheap and it will turn you into an excellent public speaker. A talent that is very useful for a lawyer or a politician. And if you join the right Toastmasters club you will make some contacts that will prove to very useful in later life.

For high school, there aren t that many electives. Choose Spanish as a foreign language, and if you can take a couple of extra history classes, that might help. When you get to college, that s a different story.

Don t just pass U S Government know it in side out. You will get more of what you need after high school. Get the basics over in college, then you can move fully focused on your goal.

I don t know what might be causing your delay, but I do know that I applied for naturalization, went through the interview process and said my oath during the 2 years you ve been waiting - and it took only about 9 months. USCIS has a huge backlog right now, but your delay pre-dates that. I would say inquire with an attorney. Do not pay a large retainer to him/her, since you don t know for sure that they can help you. At the very least the attorney might have better luck finding out what the cause of the delay is.

To or not to hire a lawyer for a speeding ticket? -

Hi I got a speeding ticket for going 59 in 45 zone in a local road in Michigan. It was a new car and I didn t know if speeds up so fast. It is my first speeding ticket over 10 yrs of driving. The fine is $115 and point 3. I went to see the matistrate and he said he can t do anything except making an appointment for a trial if I wanted to. I contacted a lawyer and he says that it s very likely that he can reduce/clear my points and his fee is $375. Is there a chance that I can do that in a court without a lawyer or I better off hiring him?

Your best bet is to go to court, plead guilty, explain the situation to the judge, and ask for leniency based on your good driving record. If you go in and accept responsibility for your actions there s a very good chance the judge will give you a break, like reducing it to impeding traffic (which is a zero-point offense and probably costs less than the speeding ticket). Just be sure to dress appropriately, be respectful, and make it clear to the judge that you know you messed up and you take it seriously. If you go in with the wrong attitude (like if you behave as if you have an axe to grind) the judge is going to BURY you. No point in wasting $375.00 for a lawyer who won t be able to do anything more for you than you can do for yourself. Good luck!

The quot;new carquot; excuse is so over used it is a joke. The car does have a speedometer does it not? If you force it to trial and lose (which you will) you will also have to pay court fees. Just pay the fine, take the points and pay more attention in the future. One ticket in 10 years is nothing to worry about. Why don t you just pay the $115.00 fine and then pay like $40.00 for traffic school which can be taken on line. I think it would definitely be cheaper and less of a hassle.

You re probably better off just paying the fine, unless the 3 points will do catastrophic things to your auto insurance premiums. Check with your insurance agent to find out for sure. I disagree with those who say you cannot represent yourself. Just by showing up for trial, you are likely to get the fine and/or points reduced. This won t happen in front of the judge, it will happen before the trial begins -- the district attorney will talk to you about your case and, unless it seems clear that you re going to shoot yourself in the foot (for example, by offering to testify that you just didn t know you were going that fast), he will almost certainly offer you a plea. Just remember, even for a speeding ticket, the burden of proof is on the government to prove its case beyond a reasonable doubt. You don t have to testify. So the government has to prove, without forcing you to testify under oath, the speed of your car on that fateful day. So, in the unlikely event that the prosecutor doesn t offer you a deal (say, failure to observe a traffic sign, for a $75 dollar fine and no points; or simply a speeding ticket for a slower speed, for a lower fine and fewer points), let the government prove its case. When it s your turn, ask the witnesses (probably the cop who wrote the ticket) whatever questions you can think of (for example, did he use a radar detector? Was it in proper working order? The most helpful thing you can do to get off is simply to show up. Don t overstate your case to the prosecutor. Don t say you weren t speeding if there s any chance he can prove you were. But tell him (if this is true) that you don t believe that he will be able to prove his case. Why would he want to bother with you, when he knows you ll probably plead guilty to a lesser charge? He said they will not issue a child support check until they have a W9 tax form on file for me. Have you ever heard of this? It sounds fishy to me. He said in order for them to garnish my ex husbands wages I had to fill out the W-9 as soon as possible so he could take it to them.

It depends on your issue - did they deny your application for SSI benefits? If so, you want someone who specializes in that. If it is for some type of personal injury - someone at the SSI Department hit you - then you want a personal injury attorney. We need more facts to provide you with an informed response.

well you can not sue a state for denying a ssi claim, but you can appeal. You would most likely need a civil lawyer, but you will not win if your only complaint is that they treated you unfairly because they denied your claim.

What courses do i need to take in college to become an immigration lawyer? -

I m 18 year old girl. I want to become an immigration lawyer but I m not sure what courses i need to take in college to begging my journey. I ve asked my High School counselor but she s no help neither is anyone else. Can you please help me out. and tell me what steps i need to take and most importantly what courses i need to take. You might consider a college or Univeristy that has legal studies or pre-law classes. Even if you find a college that has these classes, you don t have to have a major in that area to go to law school.You can choose any major in college you like and still go to law school, you don t have to take legal classes before that for them to take you. Just major is something you love and you can do well in because they put a lot of weight on your GPA when you apply. But they also put a lot of weight on your LSAT (Law School Admissions Test) which you will take probably your junior year of college if you want to go to law school right after you graduate with your bachelor s. When you get to college, find out if the school has a pre-law advisor to help guide you through preparing for law school... kind of like a guidance counselor but better and more knowledgable. Once you re in law school, you gain experience through internships and part time and summer jobs to figure out what you want to do, your college experiences won t matter as much by that point. So try to pursue the immigration law thing in college as much as you can just because you like it, but if you don t get much experience it won t prohibit you from pursuing it in law school, which is the appropriate time to do so. Actually, a lot of law schools dislike majors like quot;legal studiesquot; or quot;criminal justicequot;, and would prefer you major in an academic subject like English, History, etc. But that said, you can major in anything you d like, and with your interests in immigration law, you may want to major in something tied to immigration, such as sociology or political science, or even a specific quot;area studiesquot; or a language. But you can major in anything you d like. It s once you reach law school that you ll study law, and focus on immigration law. During your bachelors degree, it d be a good idea if you could do some volunteer work related to immigration issues/law. Everything is about balance. I don t know the situation in Nigeria, but here in the states it can be difficult. When you first begin to practice, you often must work long hours in order to get established or earn a place at a firm. Many attorneys who are concerned about having more reasonable hours, vacation time, etc, will look for jobs with the state or federal government. Those jobs will often pay somewhat less but offer more stability and regular hours as well as more vacation time and less stress.

Typing a response to your divorce papers will be difficult at best. The courts will not accept it if it is not formatted and worded correctly. Check your state s bar website. In CA they now list punishments, suspensions, etc. the lawyer has been disciplined for. I am a lawyer and my feeling is most potential clients are uneasy, for good reason, on the phone. I don t trust attorneys myself. They get a better sense of who I am and my character when we sit and talk in person. This is not always determined by how long they have been licensed or what size firm they work for. You need to ask around. Talk to people who have been in similar trouble and ask them who they used and if they were satisfied with the legal services. I would not put too much stock in Martindale Hubbell since I know some lawyers with a and b ratings who really are not that good. Some attorneys with a c or no rating are quite good but are not popular with their colleagues. Then again some lawyers with c or no ratings are pretty bad. The best indicator is from people who have had direct experience with lawyers in particular areas. Reality check: Lawyers with the quot;aquot; rating will cost you plenty.

Word of mouth is often the best way of determining a lawyer s quality. Ask around, request references from the attorney, and check with other attorneys in your area. Also, don t immediately dismiss the idea of getting a public defender - many are quite experienced and qualified (and, best of all, free if you qualify). At the least, a public defender might be able to point you in the direction of a competent attorney who specializes in the field of law you are dealing with.

Is there a website where I can check to see if my lawyer is certified or not? -

I need a website where I can check the validity of my lawyer. I ve already went to the main Bar Association website and a few others, but they either had no option to check for a lawyer, were scam sites looking for money to do a basic background check, or were just bogus sites. Does anyone know a real site? Thanks.

The state bar association where your attorney has his license to practice law should have a listing of all attorneys authorized to practice in that state.

It depends what you mean by certified. Membership in the ABA is voluntary for example. What you are looking for is if the attorney has been admitted to the bar in your state, I think (by the way, an attorney does not have to be admitted to the bar to handle legal matters, if they don t appear in court.). Each state has different procedures for that kind of check, so i can t advise as to specifics. You can also usually verify the issuance of a law degree with the issuing school for a small fee.

If you are talking about large NYC law firms then it is in the neighborhood of $150,000 per year not including annual bonuses. Fordham Law has a good reputation among NYC law firms but you would still probably need the tradional profile of being in the top 20 percent of your class and be on a law journal.

I need a lawyer in family law/divorce that knows how the Federal Government works in cases of divorce, such as spousal support, health insurance etc. How do I find that type of lawyer?

I had a bad crown put on and dentist refuse to replace or do anything about it. It is causing a lot of pressure and I was having throbbing pain. I went back to my old dentist and she told me the crown must be replaced and gave me an estimate. You have to also pass the Multistate Professional Responsibility Exam (MPRE) - aka ethics, the moral character evaluation, and the bar exam after completing law school and obtaining your Juris Doctor. All three of these cost money, although the moral character evaluation may be a bit pricier than the bar exam (you need to provide fingerprints for them to check the DOJ with). If you never pass the exam and/or ever become licensed to practice law, you can still put the J.D. after your name after graduating from law school.

Honestly, if you can do arithmetic, you ll probably be okay; my friend who s in that field is always moaning about how much she hated algebra. Of course, that won t be enough to get you into a really good college these days, so do the best you can at least through high school. You never know: you might end up with some cases where it d be useful.

How poor exactly do you have to be? Do they look at your financial record? Do they only give you a lawyer for certain crimes?

Generally you only have a right to counsel for criminal matters. To get an attorney provided by the government, you have to be charged with a felony in most places in the United States; though some jurisdictions may provide you with an attorney for serious misdemeanors. You should ask. Some communities have legal aid attorneys who will charge you on a sliding scale, based on what you can afford. You will probably have to show some sort of financial records, such as tax returns, or sign an affidavit saying that you are really poor.

You actually don t need to bring anything much to your initial interview with your lawyer. If you like, you may wish to bring your passport entry documents, marriage certificate, and any other such pertinent documents, but if you don t, your lawyer will provide you with a list of stuff he/she needs. If you already have some letter or correspondence from USCIS, then bring that. As for questions: Your lawyer should know how to handle it. You can explain your situation, what you want to do, and ask where to go from there. When you leave the office, you want your lawyer to have given you a game plan - what you need to do next, what forms he/she plans to file, and you will also want to know exactly how much he/she is charging. You should get that all in writing so you don t forget anything. You also want to know the dates by which each of the things required of you should be done. My lawyer was pretty weird. He randomly charged us five hundred dollars whenever he felt like it - but he was so disorganized that he never seemed to know whether or not we d actually paid. His desk was full of peoples important documents, all in random piles. He was moderately shifty - wouldn t talk over the phone, only in person. It is the judge or district attorney s decision whether or not to charge someone with perjury. They will look into it for you and depending on the case, they may or may not file charges. I m surprised that the judge didn t immediately do something at the time it happened. But be forewarned, no matter how important you might think this is, the district attorney may not think it s worth his time to process -- that happens quite a bit actually.

you can t charge him. a government prosecutor would do that. the best you can do is to contact the prosecutor s office and request that they investigate, which they probably won t if the court didn t even hold your husband in contempt. you could also contact the state bar association s ethics committee to complain about the attorney s conduct. they might pursue separate professional discipline.

However your rights are protected by some laws: 1. The Fair Credit Reporting Act (FCRA) gives you some privacy protection. You should research this. The lawyer might need to get your permission before he can run a credit check since he is not extending you any credit, and your credit rating does not impact the case. 2. He can find out if you have any convictions. I would ignore him. if he must ask you these questions they should apply to the case and he can subpoena you. If you are a witness you don t HAVE to say anything. If you are a witness for his side I would not show on that day.

The lawyer could do a background check on you. I could and anyone could. If there was adjudge why did he allow the badgering to continue. You can appeal to the proper court for a censure of the attorney. Find out which one and do some threatening yourself if necessary.

I don t think it s illegal for the attorney to do a background check. Lawyers have investigator s on their payroll. So it s not a big deal. But even if they do a background check on you, they can t get you into trouble for something you did in your past. You re not cooperating, so they probably think you ll testify in favor of your employer. Or he thinks you re hiding something.

Well, he might have been unprofessional and rude, but the bottom line is as long as it s even slightly relevant (and sometimes it doesn t need to be relevant at all, especially in a deposition, which is way more casual than court), he can ask you anything he wants. Where you live and what you do is a pretty standard question for any witness, and there s no reason for you to not answer other than to make it harder on this attorney, which is probably why he told you he could find out anyway (which he can, by the way).
