Why lawyer taking very long time to resolve the case? -

last year i suffered a high speed car accident because of some other motorist s fault, since he was jumping lights and driving recklessly. the insurance company of the guilty motorist provided very little compensation for the 65+ mph crash. So i hired a lawyer and the lawyer agreed that compensation is way too little, based on the heavy damages due to the crash. But it has been 11 months now, and the lawyer still hasn t resolved the case. How come? I have tried asking him this question many times but he says that i need not worry and have patience. So i want to know why its taking long time?

You should have got one of those lawyers that are quot;no recovery no feequot; lawyers. They seem to get on the cases very quick because any settlement you get, they get a portion of. You might still be able to get one of those kind of lawyers if you don t already have one and take your case to there instead.

11 months is not a long time. Courts are quite backlogged these days. But you should definitely demand a status update. Ask him to tell you how settlement negotiations have been going. I hope he is working on contingency.

Lawyers are like every other business. If you don t like the service, go somewhere else.

Dude, 11 months? That is basically a year. F*ck that guy and get someone else if you can afford it. If not, wait around till a little bit after the holiday season just to give him time. Bug him every couple of weeks.

Hi there, I live in Australia. On the 1st June 2004 I was hit by a car that came through a stop sign, driver was charged with failing to stop and neg driving. My partner and I got hurt and our bike totalled. He was air lifted to hospital, unable to feel his legs and I was taken by road to the local hospital. It took them 6 months to pay up for the bike even then they didn t pay what it was worth. Or full replacement costs for the gear. But the driver who hit us had a new car within two weeks. We are still waiting for compensation. The insurance company has had us see their nominated doctors. We have seen our own doctors. I have been back to be reassessed by the insurance companies doctors. The insurance companies like to drag things out. Just in case you get better and then they don t have to pay you. At first the delay is to make sure your condition is stable. Then the wait to see if you get better. Now both of us have had our disability % given to us. So there should be compensation for that. On top of that is loss of earning capacity. This can be the really tricky bit. I can t even get a low paying office job because of the accident. My solicitor told me two months ago that he was hopeful of an offer this year. I am very doubtful of this as it is almost November. So if it is going to happen then it will have to be soon. The other reason insurance companies like to drag it out is that whhen they finally do make and offer of compensation, you will take it just to have it all over and done with. They are well into the 3rd year now. If they think I am going to take less than what I am worth they are sadly mistaken. Sorry I can not be of more help. But that is what is happening to us.
