Is there any punishment for a lawyer who forges the signatures of his clients children on Vakalath form? -

One person lodged a false case against me in cilvil court in india. Later he died. Neither his wife nor his children are interested to continue the case.But the lawyer wants to continue the suite as revenge and for monetary benifit. He has submitted the vakalath form to the court with forged signatures of the children of the deceased person. The suit is still continuing and whereabouts of the children is not known.What should i do now?

You just have to tell all this to the judge of the civil court where this case is pending amp; request the court to stay the procedings in this case till the real petitioners i.e. the children of this deceased man make there presence marked in the court on next date of hearing.

Tell your lawyer to check Order 9 rule 8 amp; 12 of the Civil Procedure Code, if the petitioner fail to appear in person on next date of hearing,their petition can be got dissmised on the basis of these provisions. Report Abuse

I d call the police. Forgery is illegal most places.

so obious there is a punishment under IPC and he can be charged on the 420 case

You have to locate the children first otherwise how do you prove that the Signatures are forged unless you do possess the children s true signature to prove your point. If at least the wife of the deceased could be made to say that neither she nor the children are interested in the case and testify that the signatures are forged. In either case the whereabouts of the children is essential.
