Can I switch lawyers in a family dispute case? If I feel my present lawyer isnt knowlegeable, or aggressive ? -

We are involved in a family dispute case involving the estate of our deceased mother. Our present lawyer doesn t seem very aggressive, and or knowlegeable. We would like to know if we can get another lawyer, even though we have already started the proceedings with the first lawyer. Also, the judge is delaying (stalling?) or??? in taking any kind of action, perhaps hoping the case will go away?

You can fire your present lawyer at any time. I doubt the judge is stalling, this type of case just takes a long time. Good luck and God Bless

Most judges must look at the file every time something comes up to remind themselves about what the case is about, because they don t know or care who you are or what your case is about. As to your lawyer, yes you can get a new one. Ask yourself, however, if you have any basis for evaluating whether he is knowledgeable. If you do have such a basis, then take the case over yourself. Regarding aggressiveness, every lawyer finds their own style of practice and those who practice a scorched earth policy can never get anyone to agree to anything as simple as a one day extension of time. Go with the polite lawyer.
