What type of a lawyer do I need for an internet purchase, live in Tx, co. in CA? -

I purchased a moped from a company in Clovis, California and have gotten nothing but the run around. I live in Texas and bought the moped from their web site via a bank deposit at a Bank of America. I am now ready to take legal action. What is the type of lawyer I should be looking for?

You shoot off your case and their lawyers are shown the info, then they might choose to take it or not and quote you a price, then you choose who you go with. You get to thoroughly check the lawyer s backgrounds etc, it s good because you just spend 15 minutes with the site and that is it. You could have a choice of a few lawyers.

Call the District Attorney in Clovis, California, and find out if you can prosecute for fraud. If that fails, you can file a civil suit. But likely the person is a thief, and even if you win you will not get your money back. You will be out attorney fees, time and lots of trouble. If the purchase was thru eBay let them know and they might be able to help you get your money back. Good Luck

You should look for a general practitioner or someone who specializes in business law. If they agreed to sell the scooter to you, it is highly likely that you can sue them in Texas (because they chose to do business with you there, subjecting themselves to the law of your state by doing so.) Keep in mind that an attorney can cost a lot of money, and it is up to you whether you are willing to shell out the cash, especially if the value of the scooter is not that much.

A CA civil attorney to sue them in CA for breach of contract and fraud. You can also sue them in Texas, in federal district court, but that is probably more expensive--they will try to remove it to CA.
