How do I get a court apointed lawyer? -

My son has to appear for a citation and he is truly innocent of this. The charges are for open container and contributing alcholol to a minor. I am in Iowa, and cannot afford a lawyer, what and how do we do this?

Only if it s a DUI, or a felony or if they face serious jail time, will they be awarded a public defender. Son will need to show up and pay a hefty fine after pleading out.

Go to your local court house and ask them in how to apply for a public defender..they should be an application for you to fill out and send in

states vary, but in general an attorney will only be appointed if he is facing over a year in prison, but Iowa may have different rules. He needs a job and lawyer, fast. He needs to borrow if possible or work out an arrangement. Does he have a skill to trade, paint his house, prune the trees etc.

when he is arraigned, he can demonstrate to the court that he can t afford a lawyer, not you can t afford one, and one will be appointed for him. I suppose you can call the public defender s office ahead of time to get the details.

Talk to your local court and/or prosecutor, they will be able to give you the answer. Unless your son is a minor, and since he s being charged with contributing I would guess he s not, I m sure he s going to have to be the one to request it.

He is only entitled to counsel if there is potential for incarceration. In most of these minor cases, the judge will commit to no jail sentence before the trial and then would not appoint counsel. Otherwise, at the initial appearance the judge will ask if he has a lawyer and wants a lawyer and then the judge (not you) will determine if he can afford a lawyer.

The court appoints lawyers for criminal matters .... not civil matters
