I have a judgement against someone for them to pay lawyer but lawyer is after me for the money? -

we have a judgement against our builder finally settled after 4 years. The judgement was for the builder to pay all legal fees plus what he owes us. Now our lawyer is coming after us for the money because they can t get money from the builder. Do not understand why we have to pay when the judgement was against builder.

I wouldn t pay....if you have a judgement that says the builder was supposed to pay your legal fees...tell the attorney to go after the builder....you know what, he (the attorney) knows full well that just because you have a judgement doesn t mean you ll have the money...he knew that going in....he took the case thinking you d pay....now he ll probably try and scare you into paying tell him to take a hike...

I would refer the judgment to a collection firm that is really aggressive. I think that you may be able to fight having to pay the lawyer because of the judgment. Its hard to say, because I don t have the file in front of me. TIP: If a lawyer gives you advice without looking at the whole picture, its probably not good advice. I am an attorney.

The lawyer was working for you. He was contracted by you, not the builder. Therefore, if the lawyer cannot collect from the builder, to whom the liability was assigned, he must collect from somebody. Since you are the one who hired him, you would be the default responsible party for the fees. After that, you can try to collect reimbursement from the builder.
