Is it possible to file for bankruptcy with out using a lawyer? -

Is it possible to file for bankruptcy with out using a lawyer? I am so broke! I already try 3 years ago consolidating my debts but aftre about 9 months stop paying my monthly payment. I dont have a job! Any out there has field for B.K with out paying for an attorney?

Yes it is possible, it is called filing quot;Pro Sequot;. However, filing for a bankruptcy has become more complicated since the rules were updated in 2005. In order to even think about doing this you have to be very detail oriented. There are very specific guidelines, and things you must do. If you fail to do something required you run the risk of having your entire bankruptcy dismissed. You should at least consult an attorney. Most will give you a free short consultation to tell you what your situation is. The one advantage in getting a lawyer is they know how to fill out the forms and what the trustees are looking for. There are a few forms that if you fill them out incorrectly, you again run the very good possiblity of having the bankruptcy dismissed. If you can t afford an attorney, you might want to look into legal aid. Sometimes there are programs for people with low/no income for free or reduced legal services. If you still feel you need to file on your own then go to your local book store and pick up a book on filing. There are several out there, but be sure that it includes the updated regulations.

You will need 6 months of bank statements, 6 months of paycheck stubs, 2 years of information of taxes filed, any investment information. You can go to google.com and type in legalhelpers and it will give you a world of information. I believe you can go to office max and they have the bankruptcy forms there along with rental forms, divorce forms, etc... then get the forms and fill it out, take the information I told you and go to district court in your area and have the trustees look over the paperwork and they will tell you what else you need for them to file it for you.. It is a horrible idea to file bankruptcy without an attorney, there are many requirements that the average person (and many attorneys) is not familiar with. If you can t afford one, you can probably hold off on filing until you have the money to get one as you are probably what is known in the bankruptcy and deficiency world as quot;judgment proofquot; as you have nothing to garnish. If you really want to file without an attorney, you still need to round up the $50 to do credit counselling prior to filing $299 to get the case filed, and another $50 for the debtor education class you have to take after filing. I really really stress that it is a bad idea to file without an attorney. You are more likely to miss an important aspect like an exemption or item to disclose without one. And you probably can hang on until you have the money.
