What does one do when he or she thinks that their lawyer is lying to them to make more money? Who to consult? -

This lawyer is possibly guilty of quot;conflict of interestquot; in a divorce case. She, (the lawyer), is dragging her feet and is saying that she is going to need even more money to continue after I had told her that this case needs to be finalized and that I was running out of money due health problems resulting from this issue and job retirement money loss if the deadline of Feb.2007 is not met. She still has over $800. on my tab. I have already spent over $7500. and the case was filed Feb. 27, 2005. She possesses a document that was written in legal jargon -only signed by the spouse that the lawyer was enthusiastic about using until midstream of the case and I later found out that a member of the firm was a friend of the spouse. Who can I consult to solve this problem? All answers are greatly appreciated. Thanks!

This is what lawyers(pronounced liars) allways do. They are all colluding double dealing theives working both of you for as much as they can. Yes your lawyer is working together with the opposing parties counsel to get your money. Worst of all the legal system supports their criminality so don t bother complaining you ll get nowhere, except maybe fleeced out of even more money. Your best bet would be to drop them, kiss all the money good-bye(your going to loose anyway) and go Pro per (do your own legal) this is your only real chance. But they know you won t do this so they ll end up extortting you for every penny you got. Consider this a lesson learned, never hire a lawyer and if you do NEVER give them money in advance! NEVER! If you should by chance have a back bone go to http://www.nolo.com for legal self help info and/or e-mail me i m not a lawyer but i do deal with these matters successfully.

This is what needs to be done. First, call your local bar and ask the procedure to file a complaint. Second, file the complaint with all the details, leave nothing omitted, nothing. third, make sure that you have proof of the allegations. Fourth, request an itemized statement from your attorney. Then review it and if you have any questions, ask them and don t give up until you get a satisfactory answer. Good Luck.

Do three things: first, write your lawyer a letter, and instruct her to provide you a detailed written explaination of both the history of your divorce case and her projected strategy and time frame for wrapping it up. Second, send that letter to your lawyer by certified mail. Third, send yourself a copy of the letter. When your copy arrives, do not open it - you may need to open it in front of a judge later, and the court will want to see the original, sealed and postmarked letter before you do. If I m guessing right, your lawyer will suddenly have to spread your case out in front of her to write your reply, and while she has it in front of her, will probably accomplish whatever calls and scheduling are required to complete the case. Final thing: your lawyer WILL have to reply to your letter. She works for you (you re paying her) and she is required to justify her fees. I d think your case will be resolved very quickly. Good luck. - Stuart

Well if you feel this way then you need to fire this lawyer and hire a new one to finish your case to your wishes. The next thing to do is file a grievance with the Ethics Committee. Every state has one, but in each state they have different names. This body has the power has the power to revoke a lawyer s license and other not so nice things. If the ethics committee thinks your case holds water, they will investigate and hold a hearing. If they take action against that attorney, then you should sue because you have affirmative proof there was wrongdoing and a panel of lawyers agreed.

If you only THINK your attorney is trying to milk more money out of you, think harder. She is. I had one attorney require a $5,000.00 quot;down payment.quot; He took the money and moved to another state. I was never able to get a single cent back. The attorney I hired to replace that crook also wanted $5,000.00. Then, he sat in court with his mouth shut and didn t say a word. Needless to say, I lost that one. For what it is worth, try your state s Bar Association.
