What happens when a Lawyer dies nearing the end of a criminal case? -

Say this Lawyer is against the criminal and he has enough evidence to lock him away, but then he dies, what happens?

someone in his firm probably takes over, if he was independent, I m sure its signed over with all the evidence to someone

The lawyer representing the crown ( people) is called the Crown Attorney. Every province (state?) has several Crown Attornies. A new one will be appointed. He /she will be given as much time as necessary to review the case. Then a court date will be set. to carry on. THE TRIAL DOES NOT BEGIN AGAIN. This is because it is the judge or jury who decides on innocent or guilty - not the Crown Attorney. Now if the judge dies, there is a new trial. PS The lawyer representing the defendant is called the Defense. I hope no one is planning on getting rid of the Crown?

Since this lawyer is against the criminal, I presume you mean the prosecution? If the lead government lawyer dies during a case, others from his department will complete the prosecution.. Any evidence the lawyer has is already known to both sides before a trial starts, so him dying may delay things for a short while, but not long. Others will carry on.

Well, you are allowed to get a back-up lawyer from the same agency. For free. At least you should. and the evidence he has would be past on as well. and there is no such thing as the word nearing. It would be near.

Usually in criminal cases it is a lawyer and his council therefore one of the council takes over. If not they literally start the trial all over again. It is BS I know.

the defendant gets thrown in jail no questions asked... because that lawyer was perfectly healthy

well my dads lawyer had a heart attack and he had a ticket and he just like went to court with a new lawyer, the court date went WAYYYY farther back:)
