If an estate has been filed in your local probate court (or similar repository), the paperwork in a public record. That means you do not need to be a lawyer to have access to it. This is true whether the person had a Will or died without a Will. Normally the papers filed in a probate court upon a person s death include the death certificate, the Last Will (if there is one), a Petition for Estate Administration, an Inventory of Estate assets, a list of estate debts and any accountings that have been filed. If you are either a creditor, heir or estate beneficiary you have a right to be kept apprised of any developments, notices, hearings or accountings that have been filed. If the surviving spouse fails to act, you may be able to file a petition to administer the estate. If you need additional information, you need to consult with a local attorney or solicitor.
Most likely a Wills and Estate (probate) atty. They usually are quite adept at handling these types of cases. Some even handle more testate cases of financial dillemmas.
