Without knowing the details of your claim we cannot determine if he is working in your best interests. He cannot make any kind of settlement without your approval (unless you granted him that authority). But if he feels that you have a weak case, he might suggest you settle. What happened? How come you couldn t reach an agreement with the insurance company without the use of a lawyer? You know that now that you hired a lawyer, he ll get about 1/3rd of any settlement you get.
You hired him to represent YOU. If he can t do his job, FIRE HIM and find another lawyer.
This is BS. Your lawyer is your advocate. He is under control from the State Board that controls ethical behavior. Your lawyer may be trying to let you down softly. He may know that the other side will not settle and he does not want to go to trial. I would have a square conversation with him.
