My mother s estate has for some time now been able to close (so my lawyer says) but he has not done so. He is always busy off doing something else. There were many bills that had to be paid from the sale of her house (only thing she left) All of them have been paid. What is left should be coming to me. Now, here is what I quot;thinkquot; happened. My lawyer set me up with his real estate friend who put moms house on the market,a buyer is found and we agree on the price. The house is sold and the closing takes place, the proceeds pay off moms bills. Since then the buyers have completly remodeled moms house and put it back on the market at a hefty price, to this day the house has not resold (keep that in mind). Looking through the closing documents it occurs to me I never got a copy of the check that was used to buy the house, the buyers used quot;cashquot;. I think the buyers only paid my lawyer what mom owed and were hopeing to turn a profit quickly and give me what I deserve as well.How can I prove?
If you cannot fire him, due to a legal contract for his services, you have at least two avenues. Call the legal aid bureau; if that does not work, call the number in the yellow pages for the legal disabilities bureau, which investigates the conduct of lawyers. If that does not work, call the probate court and ask for advice.
Fire him.
Your lawyer should provide you copies of all documents, correspondence and checks. There should be an estate account for which the funds passed through (and through which you are paying his fees). Who is the executor of the estate? Where is the documentation? If someone other than you is the executor - you would not see documentation and you should speak to them. Estate settlement CAN take time. What new owners do with the property should be of no concern to you.
Hire a different lawyer and watch your back!
