What type of lawyer is needed for a lawsuit? -

I had someone break into my house. They were working for a major home builder and doing warranty work at the time of the break in. My home was scheduled for warranty work but he was not authorized to be in my house at the time. I noticed a few small items missing, totaling around $150. I also found out the company was partially to blame due to not demastering our locks properly. There are alot of other small details, but this is the major information. What type of lawsuit/lawyer would I need to file/contact for this ?

First, I would contact the Sheriff/Police Department and report the Breaking and Entering/Burglary committed by the workers. Next, I would hire a Civil Litigation/Trial attorney, to sue the workers and insurance company in Civil Court.

Is small claims court and it s in the civil department of your court house ..See if you can get a free consultation with a local civil lawyer and ask them what to do. but make sure you filed a police report..

First, get proof that the builder company s guy is guilty. Next, write the company and request reimbursement and maybe they ll pay you the loss without you doing anything further. Ir not, THEN file a claim in small claims court - usually for that small amount of money, no lawyer needs to be involved and they are not allowed in many small claims courts. Also, the court usually has a simple form you fill out so you don t have to draft a big complaint. If you do file a complaint, name the man you think was guilty, AND the company he was representing, AND any supervisors that should have been watching him AND anyone else responsible. You have a bigger chance of getting a quick settlement (and ask for your court fees on top of the $150).

It is my understanding that anything under $500 is a misdemeanor for collection on theft, you need evidence of items actually stolen, like--caught on home security video, fingerprints, etc. What did the police say? Did you file a damage claim right away? They need it on file because a crime was committed. That s step 1. Also file a complaint with the BETTER BUSINESS BUREAU. Find out if there are other claims against this builder. Ask their advice. The BBB can make or break a business.
