Even if she quot;signed away all rightsquot;, that is NOT binding on HIS life insurance policy, which is a contract in and of itself. You need a civil trial lawyer, and you re going to have to pay him up front - probably $5,000 to start, $250 an hour is the going rate. Because you re going to lose this. Sorry.
Did your husband designate a beneficiary in writing to his life insurance company? If so, that party gets the money. The insurance company can only pay the benefit to the named beneficiary(ies). It does not become part of his estate unless his estate is the beneficiary.
